If You Own a Home in the Ewa by Gentry Development in Honolulu, Hawaiʻi, You May Qualify for Home Repairs and Your Rights may be Affected by a Class Action Settlement.

  • A Settlement has been reached with Gentry Homes, Ltd. (“Gentry” or “Defendant”) in a class action lawsuit claiming that Gentry constructed the Ewa by Gentry homes using holdown straps and/or mudsill anchor straps (collectively, “Hurricane Straps”) that may be corroding prematurely. The Settlement would pay all costs of repairing and replacing the Hurricane Straps (the “Repair Program”).

  • You may be a part of the Class, which includes all homeowners whose Gentry homes were substantially completed on or after July 20, 2011, in the housing development known as Ewa by Gentry, located in the District of Ewa, located in the City and County of Honolulu, Island of Oahu, State of Hawai‘i.

  • Your rights are affected whether you act or do not act. Read this website carefully and completely.

SUMMARY OF YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT

Do Nothing

If you do nothing, you will be enrolled in the Repair Program and will be eligible for Hurricane Strap repairs. You will be notified by postcard if the Court grants final approval of the Settlement and be provided information for the Contractor so that you and the Contractor can schedule your repairs.

Object to the Settlement by January 19, 2025

You can object to the Settlement by writing to the Court about why you do not like it.

Exclude Yourself from the Settlement by January 19, 2025

If you wish to be excluded from the Settlement, you can exclude yourself by submitting a Request for Exclusion.

Attend the Court’s Fairness Hearing on February 12, 2025

You can ask to speak to the Court about the fairness of the Settlement.
